Service Terms & Disclaimer

Downrange Bike Works, LLC
Effective Date: 2/1/2024

By requesting, authorizing, or allowing Downrange Bike Works, LLC (“Downrange,” “we,” “our,” “us”) to perform service on your bicycle, you (“Customer”) acknowledge that you have read, understood, and agreed to these Service Terms & Disclaimer, whether accepted by physical signature, digital signature, electronic checkbox, text confirmation, or conduct.

1. Authorization to Perform Work

Customer authorizes Downrange Bike Works, LLC to perform inspection, repair, installation, and service as requested. This includes the right to test ride the bicycle when necessary to verify proper operation and safety.

2. Pre-Existing Condition

Customer acknowledges that bicycles and components may have pre-existing wear, damage, fatigue, or defects that are not visible during initial inspection. Downrange is not responsible for failure of parts due to prior wear, corrosion, improper installation by others, manufacturing defects, or normal fatigue.

3. Estimates and Additional Repairs

Estimates are not guarantees. If additional repairs or parts are required, Customer will be contacted for approval before work continues when reasonably possible. Downrange reserves the right to proceed with safety-related repairs if the bicycle is deemed unsafe to operate.

4. Payment Terms

Payment is due in full upon completion of service and prior to bicycle release.
Unpaid bicycles left more than 7 days after service completion may incur a storage fee of $10 per day, unless otherwise agreed in writing.

5. Abandoned Property

Bicycles left unpaid or unclaimed for 60 days may be considered abandoned and handled in accordance with Utah state law, including sale or disposal to recover service and storage costs.

6. Parts and Supply Delays

Downrange is not responsible for delays caused by manufacturers, distributors, shipping carriers, or backordered components. Estimated completion times are not guaranteed.

7. Customer-Supplied Parts

Downrange does not warranty or guarantee customer-supplied parts. Downrange is not responsible for failure, incompatibility, or damage caused by parts not purchased through Downrange Bike Works.

8. Used Parts and Certified Pre-Owned Bikes

Used components and Certified Pre-Owned bicycles are sold and serviced as-is unless otherwise stated in writing. Downrange makes no warranties beyond those expressly provided at time of sale.

9. E-Bike and Electronic Systems Disclaimer

Customer acknowledges that e-bikes contain complex electrical and electronic systems. Downrange is not responsible for battery degradation or failure, motor failure, firmware or software issues, manufacturer defects, or electrical system malfunctions not directly caused by negligent installation or service. Battery condition and electronic performance cannot be guaranteed after service.

10. Pickup, Delivery, and Transport

When pickup and delivery services are used, Downrange will take reasonable care in handling and transport. Downrange is not responsible for minor cosmetic wear, road debris damage, or issues caused by pre-existing structural or mechanical weaknesses unless caused by gross negligence.

11. Safety and Assumption of Risk

Customer acknowledges that cycling involves inherent risks, including injury or death. Downrange does not guarantee rider safety or performance outcomes. Customer assumes all responsibility for safe operation, proper use of safety equipment, and compliance with local laws.

12. Limitation of Liability

To the maximum extent permitted by law, Downrange Bike Works, LLC shall not be liable for indirect, incidental, or consequential damages, including loss of use, loss of income, or personal injury not caused by proven negligence.

13. Warranty on Labor

Downrange provides a 30-day workmanship warranty on labor performed. This does not cover normal wear, abuse, crashes, environmental exposure, or failure of parts.

14. Media and Marketing

Customer grants Downrange permission to photograph bicycles for documentation and marketing purposes unless declined in writing.

15. Governing Law

This agreement shall be governed by and interpreted in accordance with the laws of the State of Utah.

16. Agreement Acknowledgment

By requesting or authorizing service, completing a digital checkout, providing electronic or text-based confirmation, or signing a work order, Customer confirms they have read, understood, and agreed to these Service Terms & Disclaimer.
